Terms of Service

1. Acceptance of Terms

By accessing or using Plume ("the Service"), a personal project operated by Robin Bonduelle, based in France, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

You must be at least 16 years of age to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

2. Description of the Service

Plume is a document signing platform that allows users to upload PDF documents, place signature fields, and send documents for electronic signature. The Service is provided free of charge.

3. User Accounts

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to:

  • Upload, transmit, or distribute any content that is unlawful, harmful, defamatory, or otherwise objectionable
  • Forge documents, impersonate any person, or falsify signatures
  • Violate any applicable local, national, or international law or regulation
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to gain unauthorized access to the Service or its related systems
  • Use the Service for any illegal, fraudulent, or abusive purpose
  • Upload documents containing malware, viruses, or malicious code

5. User Content

You retain all ownership rights to the documents and content you upload to the Service. By uploading content, you grant Plume a limited, non-exclusive license to store, process, and transmit your content solely for the purpose of providing the Service.

You are solely responsible for the content you upload, including ensuring that you have the legal right to upload and share such content and that it does not infringe on any third party's rights.

6. Electronic Signatures

Plume facilitates the placement and collection of electronic signatures. However, Plume does not guarantee that electronic signatures created through the Service will be legally binding or enforceable in any jurisdiction. It is your responsibility to determine whether an electronic signature meets the legal requirements applicable to your specific use case and jurisdiction.

Plume is not a certified electronic signature provider under eIDAS (EU Regulation 910/2014) and does not provide qualified or advanced electronic signatures. The Service provides simple electronic signatures only.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. PLUME EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Plume does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Plume does not warrant the accuracy, reliability, or completeness of any content or information provided through the Service.

Plume makes no guarantees regarding the availability, uptime, or continuity of the Service. The Service may be modified, suspended, or discontinued at any time without notice.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PLUME AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or alteration of your data or transmissions
  • Any documents signed or processed through the Service
  • Any interruption or cessation of the Service
  • Any bugs, viruses, or other harmful code transmitted through the Service
  • Any errors, inaccuracies, or omissions in the Service

IN NO EVENT SHALL PLUME'S TOTAL AGGREGATE LIABILITY EXCEED ZERO EUROS (€0), AS THE SERVICE IS PROVIDED FREE OF CHARGE.

9. Indemnification

You agree to indemnify, defend, and hold harmless Plume and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

11. Service Modifications and Termination

Plume reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. Plume shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Plume may terminate or suspend your access to the Service at any time, for any reason, without prior notice or liability.

12. Intellectual Property

The Service, including its design, features, and content (excluding user-uploaded content), is owned by Plume and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

13. Changes to These Terms

Plume reserves the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on this page. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of France. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of France.
